About 81% of Texas voters approved a change to the Texas Constitution to allow the freezing of homestead property tax for disabled and over-65 homeowners for city, county, and municipality homestead taxes in the same manner as school tax is now frozen. The vote to change the Texas Constitution was on September 13, 2003. Proposition 13 allows taxing officials to freeze homestead tax for disabled and over-65 homeowners beginning in 2004 without a vote by voters residing within the jurisdiction of the taxing entity (city, municipality, or county). If the taxing body over a taxing entity does not freeze homestead tax for disabled and over-65 homeowners, a petition by 5% or more of the voters in a taxing entity (city, municipality, or county) can force a local election regarding this matter. Voters is Texas delivered a mandate on this matter on September 13, 2003. We believe officials should act without having to be petitioned. ASK your Mayor and Members of your City Council to freeze your city tax. ASK your County Commissioners, the Trustees of your local county college, and the Board of Managers of your County Hospital to freeze tax for the disabled and over-65 homestead owners within their jurisdictions. If your city and county officials do not respond positively to your request to freeze homestead tax for disabled and over-65 taxpayers, you may wish to force an election and let the voters decide.
