THE TEXAS NORTHEAST TARRANT COUNTY SENIOR LEADERSHIP GROUP

TAX PETITIONS TO FREEZE DISABLED AND OVER-65 HOMESTEAD TAX

If you cannot convince the officials in your taxing entity to freeze homestead tax, you may decide to coordinate a petition drive to force an election to freeze the tax.  If you do, you will need to obtain valid signatures of 5 percent (5%) of the registered voters who can vote in your taxing entity (city, county, or junior college).

To be successful, you will need a group of citizens to coordinate the petition drive.  Petition drives in cities may be coordinated with county wide petition drives.  By doing so, it may be possible to use signatures on city petitions to support county wide petition drives.

To determine the minimum number of signatures you will need for your city, county, or county college; you should check with your city, county, or county college officials to confirm these numbers.

 THE TEXAS ELECTIONS CODE

Section 277.002. Validity of Petition Signatures

This section of the Texas Elections Code was updated in September 2003 as a result of action by the 78th Legislature.  It states that a petition must include "date of birth and residence address; or (ii) voter registration number and, if the territory from which signatures must be obtained is situated in more than one county, the county of registration".

To see the full text of Section 277.002 of the Election Code as revised in September 2003, CLICK HERE.  Carefully review this section prior to starting a petition drive.  We suggest the information for each person who signs the petition be in black ink.
